PDQ GIFT CARD TERMS AND CONDITIONS
Please read these Terms and Conditions carefully before purchasing, accepting, or using a physical or digital PDQ Gift Card. By purchasing, accepting, or using a Gift Card, you agree to be bound by these Terms and Conditions.
1. Overview and Acceptance
These Terms and Conditions govern the purchase, ownership, and use of physical PDQ Gift Cards and digital PDQ e-Gift Cards (collectively, "Gift Cards").
NOTICE: THIS AGREEMENT CONTAINS A MANDATORY BINDING ARBITRATION CLAUSE, A CLASS ACTION WAIVER, AND A JURY TRIAL WAIVER IN SECTIONS 10 AND 11 BELOW. THESE PROVISIONS AFFECT YOUR LEGAL RIGHTS TO RESOLVE DISPUTES WITH PDQ.
2. Card Issuer
Gift Cards are issued by Captiva MVP Restaurants, LLC (or its applicable affiliated entity operating PDQ restaurants, hereinafter referred to as "Issuer," "PDQ," "we," "us," or "our"). The Issuer is the sole legal obligor to the cardholder. PDQ reserves the right to assign its legal obligations regarding the Gift Cards to an affiliate or subsidiary without prior notice.
3. Redemption and Usage
Redemption: Gift Cards are redeemable solely for eligible food, beverage, and merchandise purchases at participating PDQ restaurant locations in the United States or online via eatpdq.com or the official PDQ mobile app.
Non-Transferable / Not Reloadable: Unless otherwise specified, Gift Cards cannot be reloaded with additional funds once purchased and may not be resold or transferred for commercial gain.
Exclusions: Gift Cards cannot be used to purchase other Gift Cards, pay for third-party delivery services (e.g., DoorDash, Uber Eats, Grubhub), or pay for driver tips/gratuities where prohibited by local store point-of-sale systems. Gift Cards are not valid at any stadium, arena, airport, or Test Kitchen locations.
4. No Expiration Date & No Inactivity Fees
No Expiration: Physical and digital PDQ Gift Cards do not expire.
No Maintenance or Inactivity Fees: No service fees, maintenance fees, dormancy fees, or inactivity fees will be assessed against your Gift Card balance.
(Note: Promotional, bonus, or marketing reward dollars distributed free of charge during special promotional events or through the PDQ Rewards loyalty program are governed by separate terms and may carry expiration dates as disclosed on the specific offer).
5. Cash Redemption & Non-Refundable
Gift Cards are not redeemable for cash, credit, or checks, except to the extent strictly required by applicable federal, state, or local law (such as states requiring cash redemptions for remaining balances under $5.00 or $10.00 upon request). Gift Cards are non-refundable and cannot be returned after purchase.
6. Lost, Stolen, Damaged, or Unauthorized Cards
Safeguard your Gift Card like cash. Neither Issuer nor PDQ restaurants are responsible for lost, stolen, damaged, destroyed, or unauthorized use of Gift Cards.
Replacement of lost or stolen cards is made at PDQ’s sole discretion and will only be considered if proof of purchase (original sales receipt) and card registration details are provided, and only up to the remaining unredeemed balance shown on PDQ’s system at the time of the claim.
7. Balance Inquiries
You can check the available unredeemed balance of your Gift Card:
Online: Visit eatpdq.com and navigate to the Gift Card Balance page.
Customer Support: Contact PDQ Customer Support through the official website. Visit eatpdq.com and navigate to the Contact Us button and select the Corporate Office location.
Balance updates may occasionally take time to reflect immediate purchases due to standard transaction processing delays.
8. Limitation of Liability & Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
PDQ AND ITS AFFILIATES MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE AND EXCLUSIVE REMEDY (AND OUR SOLE LIABILITY) SHALL BE THE REPLACEMENT OF SUCH GIFT CARD WITH A NEW CARD OF EQUAL UNREDEEMED VALUE.
PDQ AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PURCHASE OR USE OF ANY GIFT CARD.
9. Fraud and Unauthorized Transactions
PDQ reserves the right to refuse to accept, deactivate, cancel, or suspend any Gift Card if it reasonably suspects or determines that the card was obtained fraudulently, illegally, or in violation of these Terms and Conditions.
10. Dispute Resolution & Agreement to Arbitrate
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
A. Informal Dispute Resolution
Before filing a claim or initiating arbitration, you and PDQ agree to attempt to resolve any dispute informally for at least thirty (30) days. Written notice of any dispute must be sent to:

B. Agreement to Arbitrate
If the disagreement is not resolved through informal negotiations within 30 days, you and PDQ agree that any and all claims, controversies, or disputes arising out of, relating to, or in connection with these Terms and Conditions, Gift Cards, or your relationship with PDQ shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may assert individual claims in small claims court if those claims qualify.
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, or another national arbitration company if AAA is unable to provide arbitration. The arbitrator shall have exclusive authority to resolve any dispute regarding the interpretation, applicability, enforceability, or formation of this agreement.
C. Class Action Waiver
YOU AND PDQ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Unless both you and PDQ agree otherwise in writing, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a class or representative proceeding.
11. Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PDQ KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING, LAWSUIT, ARBITRATION, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS OR PDQ GIFT CARDS.
12. Governing Law
These Terms and Conditions, as well as any dispute arising hereunder, shall be governed by and construed in accordance with the laws of the states of operations, without giving effect to its choice of law or conflict of law principles.
13. Severability and Modification
Severability: If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
Modifications: PDQ reserves the right to change, modify, or amend these Terms and Conditions at any time at its sole discretion. Any changes will be posted on eatpdq.com and will be effective immediately upon posting. Your continued possession or use of a Gift Card following the posting of changes constitutes acceptance of those changes.
