This is a legal agreement between you and PDQ that states the material terms and conditions that govern your use of the sites. By accessing the sites, you agree to be legally bound by this agreement.

PDQ grants you a limited, revocable, non-exclusive, non-transferable license to access and make use of the sites and their content. This license does not include resale, commercial use, derivative use, downloading or copying account information for another merchant, or use of data mining, robots, or similar data-gathering tools.

Except as expressly permitted, the sites or any portion may not be reproduced, sold, resold, or otherwise exploited without PDQ’s express written consent. Unauthorized use automatically terminates permissions and licenses granted by PDQ.

Content featured or displayed on the sites, including text, graphics, photographs, images, moving images, sound, and illustrations, is owned by PDQ, its licensors, vendors, agents, or content providers.

The sites and content are protected by copyright, trademark, trade dress, moral rights, and other intellectual property laws. You may not remove copyright, trademark, or other proprietary notices from materials found on the sites.

PDQ trademarks, service marks, trade names, logos, designs, and slogans may not be used, copied, reproduced, republished, uploaded, posted, transmitted, distributed, or modified without PDQ’s prior written consent.

You may not use PDQ’s name, language, pictures, or symbols in a way that could imply endorsement without prior written consent.

You may need to create an account to access certain parts of the sites. You agree to provide true, accurate, current, and complete registration information and to maintain and update it.

You are responsible for the security and confidentiality of your password and account, and for all activities that occur under your account. You agree to notify PDQ of unauthorized use or any security breach.

You agree not to use robots, spiders, scrapers, or other automated means to access the sites without express written permission.

You may not impose an unreasonable load on infrastructure, interfere with site operations, or bypass measures used to prevent or restrict access.

Except as disclosed in the Privacy Policy, PDQ will not monitor, edit, or disclose submitted content unless required for site maintenance, required by law, or believed necessary to comply with legal process, protect rights or property, or address emergencies.

PDQ may remove material that violates this agreement or is otherwise objectionable, and may deny access to users who fail to conform to the agreement.

The sites may contain links to websites not owned, operated, or controlled by PDQ. These links are provided as a convenience.

PDQ is not responsible for third-party content, materials, or information. If you access third-party websites, you do so at your own risk.

PDQ may partner with third parties to provide services including email marketing, online ordering, food products, beverages, and gift cards.

On partner pages, the partner’s brand and terms of service may be visible. You may be bound by partner terms in addition to this agreement. If there is a conflict, the partner’s terms will prevail for that partner transaction.

You may only purchase products or items shown on the sites and delivered to an address located in the United States. Purchases may only be for personal use or personal consumption.

PDQ may refuse orders it reasonably believes are for resale outside approved distribution channels. Accessing the sites from locations where content is illegal is prohibited.

Product and service details are provided on the sites. Prices are displayed exclusive of taxes. Features, content, specifications, products, and prices may change at any time without notice.

Certain weights, measures, and descriptions are approximate. Packaging may vary. Product availability is not guaranteed at all times.

PDQ attempts to ensure that information on the sites is complete, accurate, and current, but information may occasionally be inaccurate, incomplete, or out of date.

PDQ may change price and availability information without notice, limit order quantities, refuse service, or require verification before accepting or delivering an order.

For charges or deposits for events, products, items, or services ordered through the sites, PDQ or its vendors may bill your bank card or alternative payment method.

By providing payment information, you represent that you are authorized to use the payment method. You are responsible for charges for internet access and telecommunications services needed to use the sites.

You or PDQ may suspend or terminate your account or use of the sites at any time. You remain personally liable for orders placed or charges incurred before termination.

PDQ may block access if you breach the agreement, if information cannot be verified, or if your actions may cause financial loss or legal liability.

You represent that you have the right and authority to enter into this agreement, are able and competent to satisfy its terms, and will use the sites in compliance with applicable laws.

Your use of the sites is at your risk. Information, materials, and services are provided “as is” without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, security, or non-infringement.

PDQ and its affiliates do not warrant the accuracy or completeness of information, materials, or services provided through the sites, and do not commit to updating information that may be out of date.

PDQ is not responsible for damages or viruses that may affect your computer, telecommunications equipment, or other property arising from site access, use, browsing, or downloads.

PDQ will not be liable for indirect, special, punitive, incidental, or consequential damages, including lost profits, lost data, or business interruption, except where prohibited by law.

In the event of a problem with the sites or related materials, your sole remedy is to stop using the sites. PDQ’s total liability is limited as described in the full legal terms.

You agree to defend, indemnify, and hold PDQ and affiliated companies or individuals harmless from liabilities, costs, and expenses related to your use of the sites, violation of the agreement, violation of third-party rights, violation of law, claims arising from information you provide, or use of the sites by another party through your credentials.

If you have a dispute with one or more other end users of the sites, you release PDQ and its officers, directors, agents, subsidiaries, joint ventures, and employees from claims, demands, and damages connected with those disputes.

Neither PDQ nor you are responsible for damages, delays, or failures in performance caused by events beyond reasonable control, including natural disasters, war, civil unrest, governmental actions, labor unrest, transportation issues, fuel or energy shortages, or acts or omissions of carriers.

Data collection and use, including personally identifiable information, is governed by PDQ’s Privacy Policy, which is incorporated into this agreement.

Claims relating to use of the sites and materials are governed by the laws of the State of Florida. You consent to exclusive jurisdiction of state and federal courts located in Hillsborough County, Florida.

This agreement sets forth the entire understanding between you and PDQ regarding the subject matter. PDQ does not guarantee continuous, uninterrupted, or secure site access.

If any provision is invalid or unenforceable, that provision will be struck and the remaining provisions will continue to be enforced. Headings are for reference only.
